Patents Infringement: Visa Inc, Mastercard Inc, Starbucks Corporation, Sodastream International Ltd, Diamond Resorts International & Largan 



Yesterday, U.S. District Judge Michael W. Fitzgerald issued his tentative ruling at a hearing in Los Angeles declaring that Visa Inc (NYSE:V) and Mastercard Inc (NYSE:MA) have not infringed a patent owned by SmartMetric Inc., a technology development company, which sought $13.4 billion in damages. Visa Inc (NYSE:V) shares were up 0.39%, Mastercard Inc (NYSE:MA) shares edged up 0.23% in premarket.

Starbucks Corporation (NASDAQ:SBUX), the Seattle-based coffee chain, filed an application to register a trademark “Fizzio” that could be utilized for a home soda machine similar to those made by Israel’s Sodastream International Ltd (NASDAQ:SODA). According to the database of the U.S. Patent and Trademark Office, on Sep 18, the coffee company filed the application. The application also lists flavored and unflavored water, mineral water, sparkling water, fruit juices, sparkling fruit, soft drinks, fruit drinks, juice based beverages, soda beverages, frozen fruit beverages and frozen fruit-based beverages.Starbucks Corporation (NASDAQ:SBUX) shares were off -0.01% in premarket, Sodastream International Ltd (NASDAQ:SODA) shares fell -0.87% in last session and closed at $64.94.

The U.K.’s Guardian newspaper reported that a Vietnamese restaurant in South London, Mo Pho restaurant, received a notice from a restaurant Pho Holdings Ltd blaming it of infringing a “pho” trademark. According to the Guardian, Pho is Vietnam’s national dish and a fastener at Vietnamese restaurants. Pho Holdings said that they has registered the mark six years earlier and no one else is entitled to use that word in a restaurant name.

Diamond Resorts International Inc (NYSE:DRII), the Las Vegas based time share vacation property operator, filed a suit against a Virginia company, Diamond Resort Marketing Services Inc, accusing it for trademark infringement. The Virginia company is accused of confusing the public by using similar marks to those related to the Las Vegas company. The company sought at least $2 million per infringed trademark, asking that the Virginia company must be punished for its actions. The company also required to awards them litigation costs and attorney fees. Diamond Resorts International Inc (NYSE:DRII) shares were up 0.27% in last session and closed at $18.79.

Largan Precision Co., Ltd (TPE:3008), a Taiwanese maker of lenses for handset cameras, accused Ability Opto-Electronics Technology Co  for stealing its trade secrets, according to a report by China Post. Largan asked a court in Taiwan to seize a competitor’s working capital, liquid assets and production equipment.
